| 摘 要： | 一船之上,并存数担保物权时,各类型权利间关系若何,各国法规定不一,我国海商法第25条对此亦有明文,但简单化的处理,使得立法现状与当事人利益保护的立法主旨,已有所不符。甚有必要对该问题作以学理分析。

| Abstract: | On the occasion that several security interests exist in one maritime property ,with the arrangement of the relationship among them ,different country have different resolution. The maritime law in China also prescribe it. Although this clause is simple on solution, it seems unfit to the legislative intent and the protection of the parties interests. It is necessary to discuss this problem in the perspective of comparative law and other aspects. |
