| 摘 要： | 对中美两国新闻诽谤抗辩权的异同从四个方面进行了对比分析,将这种抗辩权具体划分为有条件的抗辩权、绝对抗辩权,部分抗辩权,公众人物与实际恶意。通过案例分析,对中美两国新闻诽谤抗辩权的本质内涵进行了探讨和界定,以期对我国新闻管理法制化有所借鉴和启示。

| Abstract: | Contrastive study on the Sino-American Press malign defense right was carried out from four aspects: conditional defense right, absolute defense right, partial defense right, public figure and practical malignancy. Through case analysis, the natures of both the Chinese and American press's malign defense rights are defined and probed into, so as to offer reference and enlightenment for the legislation of press management in China. |
