回应的无力——读诺内特与塞尔兹尼克著《转变中的法律与社会:迈向回应型法》

美国法学家塞尔兹尼克与诺内特的“回应型法”理论欲解决法律的完整性和开放性之紧张关系,从而实现法的程序正义和实质正义的完美共存,其理论有一定的参考价值,但该理论很不成熟,且存在一些致命的缺陷,如回应型法理论的核心概念“目的”难以普遍化和具体化,作者对回应型法理论的严重不自信,法的完整性和开放性的紧张关系难以克服,以及作者的研究进路中存在参照系混乱等等。

Weak Response

The theory of responsive law proposed by American law experts P.Nonet and P.Selznick attempts to resolve the strained relations between the completeness and openness in law so as to realize the coexistence of procedural justice and real justice.This theory,though with some reference value,is far from mature and has some fatal defects.For example,the central concept of responsive law theory-goal-is hard to become generalized and concrete;the authors do not have full confidence in this theory;the strained relations between the completeness and openness in law is hard to eliminate;and the authors used different reference frames in their research.
