现行农村宅基地产权制度探析

剖析了我国农村宅基地产权制度的基本特点,即:集体所有,村民使用;依法拥有,集约利用;保障安居,限制流转.揭示了我国农村宅基地产权制度的局限性:与完善社会主义初级阶段基本经济制度的取向相冲突,与促进农民财产性收入增长的意愿相冲突,与集约节约利用土地资源相冲突.提出了统筹城乡发展,完善农村宅基地产权制度,推进农村宅基地流转市场化,开放农村集体建设用地市场的政策建议.

Study on the Rural Housing Land's Property System Construction in Countryside

The land property right is the key problem in the land institution. The paper analyses the basal characteristics of the rural housing land's property system in China: socialist collective ownership, villager use; legal possession, intensive use; guarantee comfortable inhabitation, restrict circulation. The limitation of the rural housing land's property system is revealed. It is collided with the tropism of perfecting the basal economy system in the primary stage of socialism. It also comes into collision with the desire that promote farmers to increase their wealth income and the idea that land resource must be intensive frugally used. At last policy advices are put forward such as balance urban and rural development, consummate the rural housing land's property system construction, boost the marketization of the rural housing land's circulation and open the market of rural collective building land.
