| 摘 要： | 判例制度的形成需要多方面的条件，这些条件的成就必定是一个循序渐进的过程。最高人民法院发布的“案例”在审判实践中发挥着类似于判例的作用，这是一种带有过渡性质的、向判例制度发展的法律现象。
