| 摘 要： | 科技计划项目合同是科研合同的一种,是指政府科研管理部门与科研机构或人员之间,为完成一定的科研项目,确立双方权利义务关系而订立的合同,它属于民事契约而非行政合同。目前我国的科技计划项目合同制度仍存在任务书与合同相混淆,合同条款内容模糊,权利义务约定不对等,责任机制不完善等问题,需要从合同的确定方式,应约定的事项以及责任机制3方面加以完善。

| Abstract: | As a Scientific Research Contract,the contract of National Science and Technology Planning Project(NSTPP) is a civil contract in which the science and technology management department and scientific organization or researcher establish their privilege and obligation in order to achieve the purpose of the National Science and Technology Planning Project.It is civil contract rather than administrative contract.At present there are many loopholes in the institution,we must improve and perfect the institution in every direction. |
