| 摘 要： | 抵押权的法律属性与抵押权人的权利有着密切联系。一方面，抵押权的法律属性是抵押权人权利的效力渊源；另一方面，抵押权人的权利则是抵押权的法律属性的外在表现。抵押权具有限制物权性、价值性、从属性等法律属性。抵押权人的权利包含抵押权的积极内容和抵押权的消极内容两个方面。

| Abstract: | There is close connection between the legal attributes of mortgage and the rights of mortgagee. For one hand, the legal attributes of mortgage are effective sources of mortgagee＇s rights. On the other hand, mortgagee＇s rights are the out expressing for the legal attributes of mortgage. The mortgage possesses the legal attributes of limited right of things, value and subordination. While the mortgagee＇s rights include two aspects of mortgage： active and inactive . |
