死刑独立量刑程序的必要性研究——以死刑案件司法实务为视角

我国当前死刑案件审判的核心在于量刑而不是定罪,与此同时,越来越多的酌定量刑情节在决定是否适用死刑上前所未有地发挥起关键性作用。我国传统以控制定罪为中心、定罪量刑一体化的审判模式及制度安排,已明显滞后于当前死刑案件审判的实践需要及形势发展,构建专门、独立的死刑量刑程序,通过正当程序实现量刑公正已成大势所趋。

Study of the Procedural Necessity of Independent Penalty Measurement in the Death Sentencing

the core of death penalty trial in our country at present is not to convict somebody of a crime,but to measure the sentencing.At the same time,more and more discretionary circumstances in sentencing plot unprecedentedly plays a critical role to decide the death penalty.China’s tradition is to take the conviction control as the center.The integrative trail mode and the system arrangement in the conviction and sentencing have lagged behind the current trial practice in death penalty cases and situation development.To construct a special,independent death penalty sentencing procedure and to realize sentencing justice have already become an irresistable trend through the proper procedure and the sentencing justice.
