| 摘 要： | 鉴于司法实践中一直存在着一定数量的符合辩诉交易特征的做法,我国应当在立法上明确认可辩诉交易。但在引入过程中,决不能不加分析的全盘照搬,必须依据中国国情加以适当限制。同时,要建立健全辩诉交易的审查监督机制和相关的保障性制度。

| Abstract: | In view of the existence of modus operandi with the characteristic of plea bargaining in judicial practice,our country should affirm the system of plea bargaining in legislation definitely.However,we shouldn't copy it without any analysis.We should apply it restrictedly on the basis of the situation in China.At the same time,the supervision and redress system must be established adequately. |
