论梁漱溟先生建设中国社会新秩序的思想--兼谈本土资源派与法律移植派之间的论争

梁漱溟先生认为传统是新秩序的立基之本,建设中国社会新秩序必须立足于自己的民族传统。借鉴是新秩序的活力之源,即必须借鉴西方的团体生活样式来组织中国民众,激发中国人生命中固有的人生向上的真精神,这样才能使中国社会结束散乱局面,形成合力。而自上世纪九十年代以来本土资源派与法律移植派之间关于中国法治化道路选择的论争实是梁漱溟先生已有思考的继续。

On Liang Shuming's Thinking about Constructing the New Sequence in Chinese Society --Discussing of the Controversy between Mainland Resource School and Law transplant School

This paper explores Mr.Liang Shuming's thinking about constructing the new sequence in countryside by explaining his theory about the construction in countryside.Mr.Liang Shuming proposes a point of view that the tradition is the base to construct the new sequence.Enough attention should be paid to our nation's tradition.Use for reference is the source to get more vigour.The life style in west can organize the people,excite the spirit,help to end the scattered conjuncture in China and produce more strength.And in fact the controversy happened between mainland resource school and law transplant school since the 1990's was the continuation of Mr.Liang Shuming's thoughtfulness.
