论知识产权法上的知识概念

不同的学科有着不同的知识概念，但在知识产权法上一直没有适合本学科特点和要求的知识概念。形式说认为，知识的本质是形式，知识产权是一种形式产权，但是形式说存在着过于宽泛、抽象等严重的缺陷。在知识产权法上，知识的本质是符号，知识产权既保护符号组合，也保护符号信息。

Knowledge Concept in the Intellectual Property Law

Different discipline has the different knowledge concept. But there is no knowledge concept that conforms to the characteristics and request of the intellectual property. The Form Theory believes that the essence of knowledge is the form, so the intellectual property is a form property. The Form Theory has several serious flaws such as being too broad and too abstract. In the intellectual property law, the essence of knowledge is symbol. Therefore, the intellectual property rights protect the symbolic form and the symbolic information.
