违宪审查制度的法哲学思考

To construct an effective mechanism for determining unconstitutionality is an important action needed to strengthen the constitution's executing and supervising functions.For a constitution-ruled country this step in inevitable and correct.From the angle of jurisprudence,we should consider it from these aspects:cultivation of the peoples' trust in the supreme constitution,treating humanity rationally,the protection of human rights,restriction of undue power,responsibility of the law and rightly looking at the status of People's Assembly.It is important to find out the theory of constructing an effective mechanism for constitutional rule.Exploring this problem not only for the perfection of theory,but also the innate good of proper constitutional practice and exclusion of unconstitutional acts.
