法学本科阶段《中国法制史》教学体例与内容的思考

摘    要:现行中国法制史的本科教学体例与教学内容存在不少缺陷,内容的大量重复以及轻视法的实效问题使其越来越无法适应法学人才培养的要求。因此,必须对本科阶段中国法制史教学进行相应的改革,在教学体例上采取“大时段、小专题”的形式来代替“断代式”的编排,在内容上采取法律条文与司法案例相结合的方式。

Abstract:The present style and the content of the legal history of china have some flaws.These flaws include two parts: the contents of the Chinese legal history are greatly overlapped and the legal actual effect is despised.As a result,The present style and the content of the legal history of china could not suit the present demand on undergraduate jurisprudence education in universities.The style needs to be changed and the content ought to be improved.The author suggests that the reform include two points: firstly,the teaching style ought to take "the long period of time,the small special topic";secondly,the teaching content ought to combine the legal regulation and the judicial cases.
