| 摘 要： | 注意义务的根据在刑法理论上分歧较大。我国法律界对注意义务有许多歧异观点，目前很难有明确的标准，对注意义务的根据进行具体分析，有助于人们明瞭法律、法规、契约所确定的注意义务，这是落实社会生活秩序的一般要求。
