| 摘 要： | 机动车的广泛应用对整个社会经济生活产生了深刻的影响.但另一方面,机动车引起的道路交通事故也与日俱增,给人们的生命财产带来极大的危害.而在道路交通事故的处理过程中,核心问题应当是确认责任主体,即事故当事人各方谁应当对受害人的损害承担损害赔偿责任.<民法典>应当对机动车事故责任主体作出明确的规定.

| Abstract: | The extensive apply of motor vehicle has influenced deeply to the social economical life. On the other hand, traffic accident by motor vehicle is being increased steadily, and caused serious damages to people's life and property. In the course of dealing with traffic accident, the key problem is to affirm the person responsible. The civil code should be provided the person responsible of motor vehicle definitely and amply. |
