论农民法律意识的现代化

农村法治建设是我国依法治国的一个重要方面 ,但受传统法律观念、立法及司法机构的设置、执法与司法运行状况的影响和制约 ,我国农民的法律意识落后 ,突出表现在以情代法 ,权力至上 ,族规家法神圣等观念根植于农民的思想中 ,在社会生活中发生纠纷时厌诉避诉。要培养农民的现代法律意识 ,应从完善农业和农村方面的立法 ,加强农村的执法和司法 ,协调习惯法与国家法之间的关系 ,深入普法等方面入手

Rules by law of the countryside restrict the process that our country runs by law directly. Because of the influence and restriction the tradition legal idea, setting up of legislative and judicial institutions and the operations of legis lation and judicature, the legal consciousness of the Peasants of our country is backward. The outstanding behaviour is that the law is replaced by the feeling, power is the highest, sacredly domestic rule and discipline of the clan are sprouted in the peasant's thought. We train the peasant's modern legal consciousness, should start from perfecting the legislation of agriculture and countryside, strengthenning enforcing the law and administration of justice in the countryside, creating a good relation between customary law and civil law, deepening law popularization.
