论我国海外务工人员权益保护机制构建

改革开放以来,我国对外劳务合作得到了迅速发展。随着我国劳务输出人员的增多,他们在海外受侵害的概率也在上升,如何有效地保护我国海外务工人员的合法权益成为我国政府面临的新考验。为此,首先在国内要积极疏通劳务输出的渠道,在加强业务能力培训的同时要加大法律知识和应急事件处理能力的教育;其次,在对外方面要充分发挥我国驻外使领馆的作用,通过签订双边或多边服务贸易协定,甚至行使外交保护权等方式来保护我国海外务工人员的合法权益。

The Building of the Mechanism to Protect the Rights and Interests of Migrant Laborers abroad

Since the reform and opening policy was put in practice,labor cooperation with foreign countries has developed rapidly.With the increase of contract workers transition,the probability of their being infringed has risen.How to protect the migrant workers＇ rights and interests becomes a new problem to our government.At first,we should clear the channel of the export of labor service,strengthen the training of operational capacity,At the same time we should strengthen the education of law and raise the ability to handle the emergency.In addition,the embassy and consulate should play their role.Also we can sign bilateral or multilateral treaties even exercise the rights of diplomatic protection to protect the legal rights of our migrant workers.
