公私权视角下的高校学生管理

在当前社会转型时期,大学生价值观念日益趋向多元化,权利与法律意识不断增强,学生与学校之间冲突不断。文章以公私权理论为视角,厘清了高校学生管理权与学生权利的权力属性,并在此基础上,研究高校学生管理权与学生私权之间的冲突表现形式、救济机制及其解决途径。

College Student Management in the View of Public and Private Rights

Now during the transitional period of the society,college students＇ values turn out to be more and more diversified,the knowledge about rights and the law keeps increasing,and constant conflicts between students and schools have appeared.This paper makes clear of the nature of power between the power of college student managment and the students＇ rights,and based on which this paper also studies the representation of and the remedy machanism for the conflicts between the two.In the end,this paper puts forward the measures for solving and balancing the conflicts.
