宽严相济刑事政策贯彻实施存在的问题及对策——以刑事诉讼程序为视角

宽严相济的刑事政策是党和国家在新形势下对刑事司法工作的根本政治主张,是我国刑事立法及刑事司法的灵魂。该政策的提出与贯彻实施符合构建和谐社会的客观需求,是实现和谐社会的关键因素。但是,在我国目前刑事司法实践中,宽严相济刑事政策还未能得到很好的贯彻实施。文章拟从诉讼程序上对司法机关在贯彻宽严相济刑事政策存在的问题进行分析,进而提出对策,以期对刑事司法机关在宽严相济刑事政策的认识与贯彻实施方面有所裨益。

Problems and Countermeasures in the Implementation of Criminal Policy——Perspective of the Criminal Litigation Procedure

Temper justice with mercy in the implementation of criminal policy is the fundamental judicial proposition of our Party in the new situation.It is the soul of China＇s criminal legislation and Criminal justice.This proposal is consistent with the current construction of a harmonious society.The proposed policy consistent with the implementation of the objective needs of building a harmonious society.It is a key factor in achieving a harmonious society.But in our current criminal justice practice,the new policy has not been properly implemented.This paper,from the judicial proceedings of the implementation of criminal policy,analyzes the problems,and a solution is offered in order to provide some references for judicial organs in their practical use of this new policy.
