论优先权的体系化建构

在我们看来,将优先权等同于优先受偿权是不合理的,其内涵必须得到体系化的扩张。建构优先权体系有利于完善优先权制度,发挥习惯法的积极作用,修正传统的平等原则。优先权体系的建构应发挥理论研究的基础作用,同时将民法总则和分则有机结合。

On the Systematic Construction of Priority

In our opinions, equating priority with priority of claim is not reasonable, so the content of priority must be expanded systematically. The construction of the system of priority is of great advantage to perfect priority, exert the positive function of unwritten law and modify traditional principle of equality. The system of priority should attach much importance to the fundamental function of theory, and combine general provisions and subprovisions of civil code organically.
