保险单质押的可行性分析

将保险单质押获取融资的情况在现实生活中已经出现，但我国法律目前对此类业务采取不明确反对也不明示支持的隐晦态度，这种情况阻碍了保险单质押业务的发展。理论界和实务界通说都认为保险单质押仅限于现金价值返还请求权，而否定保险单下的保险金请求权的可质押性。文章认为，保险单下的这两项权利，从法律性质上分析可以质押，不应当被一概排斥在保险单质押的范围之外，保险单质押具有可行性和经济合理性。
