| 摘 要： | 电子意思表示对于电子商务合同具有重要的法律意义，但数据电文形式的电子意思表示与传统的口头或书面的意思表示形式不同，无法完全适应传统意思表示法律制度。因此在电子意思表示中，有必要对当事人行为能力进一步规制；以电子形式表现的要约与承诺，其具体应用规则也应重新界定。

| Abstract: | The digital intent declaration is of vital importance in electronic business contract dealings. But it is different in form from the traditional oral or written intent expressions and is unsuitable for the legal system based on the traditional intention expressions. It is therefore necessary to regulate further the behavioral capabilities of the parties concerned on one hand, and redefine the application requirements for offer and acceptance made in digital form on the other hand. |
