| 摘 要： | 随着高等教育的快速发展,学生与公立高校的涉诉问题日渐增多,呼唤高校实现依法治校;厘清高校与学生的法律关系是依法治校,正确处理涉诉问题的基础;要针对高校不同管理行为引发的涉诉问题适用相应的法律。
