| 摘 要： | 行为概念是刑法中行为评价机制的基点;行为评价机制可分为行为立法评价和司法评价两阶段.此划分一是有利于贯彻罪刑法定原则以保障人权,二是有利于建立二元犯罪理论以完善刑法理论体系.
