试析海战法面临的挑战及应对措施

法律是影响战争进程的重要因素之一。文中通过分析军事利益最大化、滞后性、复杂电磁环境、现代海洋法律制度等因素对海战法带来的挑战,提出了积极参与国际立法活动、守法作战、充分利用例外性条款、灵活运用海战法规则、建立海上军事禁区等应对措施,以求为未来海上作战行动提供法律借鉴。

On the challenge and countermeasure about the law of armed conflict on the sea

TLaw is one of the significant factors influencing the war process. The thesis analyzes the challenges caused by factors such as military interest maximization, complex electromagnetic environ- ment and present ocean laws. On the basis of the analysis, this paper puts forward some corresponding countermeasures to provide legal insurance for the coming armed conflict on the sea, including taking part in the international legislation, battling lawfully, making use of escape clauses, applying the law flexibly and establishing military restricted areas on the sea.
