| 摘 要： | 波斯纳财富最大化法学思想的根本内容和内在实质,都隐含在"效率"概念之中,而效率是一个涉及财富的数量、结构和运用等内容的准福利概念;财富最大化法学思想是资本精神在法学中登峰造极的表现,它突出而深刻地反映了现代资本主义社会的异化问题。
