诉讼欺诈行为探究

论述了诉讼欺诈行为的概念、类型及特征,分析了目前对诉讼欺诈行为的几种定性。赞同三角诈骗构成诈骗罪,但不同意将诉讼欺诈行为与三角诈骗等同的观点。通过对诉讼欺诈行为与诈骗罪中的诈骗行为的综合考究,认为诉讼欺诈行为与诈骗行为有质的区别,我国刑法应当增设＂诉讼欺诈罪＂。

Studies on Litigation Fraud

The concept,types and characteristics of litigation fraud are discussed.The definitions of litigation fraud at present are analyzed.It is proposed that,the tripartite fraud should be regarded as the crime of fraud,but litigation fraud is not equal to tripartite fraud.Litigation fraud and the crime of fraud are considered to have qualitative difference,by comprehensive observation and study. It is necessary to establish the crime of litigation fraud in the criminal law of China.
