| 摘 要： | 法官独立制度的确立能够从根本上保证司法独立的实现,但是它并不是一朝一夕完成的,它有自己产生的基础,有制度构成的基本要素。法官独立的确立往往被认为是法官职业阶层统治的形成,会造成法律领域的专制。实际上,法官独立机制本身包含的要素已经确保了法官专制的不可能。

| Abstract: | The judiciary independence system can ensure the realization of jurisdictional independence radically, but it cannot finish in one day. For it requires its own foundation and essential elements.The process of justice independence is always regarded as being accompanied by autarchy in judiciary field.As a matter of fact, the judiciary independence system itself ensures impossibility of judiciary autarchy. |
