国际人权保护与文化相对主义

在国际人权议题上,普遍主义与文化相对主义的人权观既相对立又在一定程度上兼容.文化相对主义强调应当以各国自身的文化基础、经济条件、社会境况以及历史传统为根据,并且以渐进、对话及合作的方式来落实人权的保障,同时配合国际社会在人权标准上不断降低相对性、增加普遍性的趋势,建构出一套真正的跨文化普遍主义人权观.

International Protection of Human Rights and the Cultural Relativism

As for the subject on international human rights, the two most prevalent interpretative approaches, namely universalism and cultural relativism, have been opposite to and compatible with each other. It should be remembered that cultural relativism, in seeking to protect certain cultural values, should not be used to deny the universality approach of human rights and universalism should not be portrayed as denying cultural diversity.
