反垄断法域外适用制度初探

随着跨国垄断行为日益突出,各国纷纷在其域外适用本国反垄断法。有关国家和组织积极寻求双边和多边交流与合作,以缓解和消除反垄断法域外适用所带来的消极影响。我国应顺应这一趋势,尽快构建我国的反垄断法域外适用制度,并在此基础上加强同其他国家和组织的交流与合作,推动国际反垄断法的形成。

A Brief Analysis of Applying Antimonopoly Law Outside and Its Countermeasure

With the transnational monopoly behavior is prominent day after day,countries are applying their antimonopoly law in outside its territory.The related countries and the organizations seek positively bilateral and the multilateral exchange and cooperation to alleviate the negative effects which the territory outside application of the antimonopoly law brings.We should comply with this tendency,Chinese system of the territory outside application of the antimonopoly law.And in this foundation,we should strengthen the communication and cooperation with other countries and international organizations,impel the international antimonopoly law come into being.
