| 摘 要： | 近些年来，精神病人犯罪的比率不小，对其周围的人的生命和安全造成威胁。也有一些危险分子钻法律的空子，打着精神病人的旗号去犯罪而逃避法律制裁。因此，我国应在立法和司法实践中加强对各类精神病的区分，明确各类精神病人违法犯罪的法律责任。政府和精神病人的监护人也应加强对精神病人的管理，防止或减小其对社会和他人的危害。

| Abstract: | In the last few years,the rate of mental patient's crime is not low,which threatens the public security and the life of the people around.Some subversives take advantage of loopholes of law,pretend to be mental patients to commit crimes and escape the legal sanction.Our country should strengthen the differentiation of all kinds of psychosises in legislating and judicial practice,define the legal liability of all kinds of mental patient delinquents.The government and the mental patient's guardian should strengthen the management of mental patients,prevent or reduce its danger to society and others. |
