儒家法律传统之近代命运

自汉以降至清末,儒家法律传统从未遇制度理念的正当性危机,然而近代以来,固有的法律传统和制度体系已不能给出现实生活的意义与价值。但作为帝制正统之儒家法律传统,其思想观念仍渗透到各个领域并发挥作用,难免使中国法律的近代化每前进一步都会引起强烈的反响与激烈的斗争。儒家法律传统在近代的命运嬗变,伴随本能的抗争最终走向解构。儒家法律传统向近代化、现代化发展与转型之路是坎坷的,其在近代之复杂命运是国人对自身法律文化与思想体系进行现代意义重建的艰难过程,其在近代的困境亦是后人重构制度儒学的历史借鉴。

The Fate of Legal Tradition of Confucian in the Modern Times

From Han Dynasty to the late Qing Dynasty,the legal tradition of Confucian had never encountered any legitimacy crisis.But,ever since modern times,the pre-existing legal tradition and institutional system had no longer been able to provide people with the meaning and value of real-life.Nevertheless,as the legal tradition of orthodox monarchy,its ideas had permeated all areas and played a role.This would inevitably cause a strong reaction and intense struggle in every step forward in the course of the modernization of Chinese law.The fate of the legal tradition of Confucian’s revolution in modern times ultimately ended up in deconstruction.The road for legal tradition of Confucian to modernization and modernization-restructuring was bumpy;its complex fate in modern times was companied with the difficult process of rebuilding legal culture and modern ideology system.We can also borrow ideas from its development over this period when we rebuild the system of Confucianism.
