文化产业立法问题初探

在讨论文化产业基本法的制定时，应注意区别文化产业基本法与一般的文化立法。文化产业立法要着眼于文化产业的特殊性，注意与现有法律法规政策的衔接和配合。在制定政策法规时尽量与WTO规则接轨，使文化产业方面的政策法规既符合WTO规则，又符合我国的实际。

Probe into the Problem of the Legislation for the Cultural Industry

When discussing on the formulation o f the fundamental laws for the cultur al industry,should pay great at-tention to distinguishing the fundamental laws and common laws of the cul tural industry.The legislation of cultural industry should lay stress on the specialitie s of the cultural industry,and pay attention to dovetailing and mating wi th the existing laws,regulations and policies.The policies,laws and regulations form ulated should join with WTO rules as m ore as possi-ble,making the laws and regulations of the cultural industry fit in with n ot only WTO rules but also our country' s reality.
