论劳动法范围内的罢工与罢工制度的实质

摘    要:文章阐述了劳动法范围内的罢工的概念及其五个构成要件,分析了罢工现象存在的原因,指出“只要劳资关系存在,罢工现象就不可避免,可避免的是罢工发生的频率和罢工剧烈程度的降低。”文章在回顾了罢工制度的形成和发展历史的基础上,分析了罢工制度的实质,指出“罢工制度能够保护劳资双方的合法权利,罢工制度是劳资激烈冲突的减压阀”。

Abstract:The article has elaborated the strike concept within the scope of the labor law and five composing elements,analyzed the existence causes of the strike phenomenon,pointing out that"as long as the employee-employer relations exist,the strike phenomenon is inevitable;the frequency of which the strike occurs and the reduction of the strike intensity can be avoided."On the basis of reviewing the formation of the strike system and its developmental history,the article has analyzed the essence of the strike system,pointing that"the strike system can protect the legal rights of both:employers and employees;the strike system is a reducer of intensive conflict between the employee and the employer."
