| 摘 要： | 反垄断法的适用除外制度应遵循三个基本原则:即有效竞争、适用范围与经济发展目标相适应、主管机关审查和公众监督相结合的原则。自然垄断行业在我国不应获得适用除外;实施适用除外制度的具体范围可包括6种情形,在实施中应设立公众异议程序。
