| 摘 要： | 既判力的实际作用主要体现在判决确定之后的诉讼中,其典型的作用是禁止当事人提起诉讼标的同一的诉讼,法院也不得作出与前诉判决相矛盾的判断。既判力的正当化根据有法的安定说、权利保障说、二元说等。

| Abstract: | The actual effect of res judicata is in the later suits after the court decision is made, i.e. the parties cannot sue for the same subject again, and the court cannot make judgements contrary to the former judgement. The foundations for validating res judicata include doctrine of security of law, doctrine of safeguard of right, and doctrine of dual sources. |
