司法被动性与能动性的有效兼容——论能动司法视角下人民法院工作的开展

针对2008年以来国际金融危机对我国经济社会造成的影响,最高人民法院提出了"能动司法"的理念,并在全国法院系统中迅速掀起了围绕"为大局服务,为人民司法"工作主题创新法院工作的热潮,如何通过能动司法实现司法效益的最大化也成为司法实务界探讨的一个热门话题。笔者在本文中首先阐述了人民法院能动司法的理论基础及现实必然,然后结合法院工作实际从宏观和微观两个层面探讨了能动司法的实现路径,并提出能动司法过程中应注意处理好四个关系。

The Effective Compatibility between Passivity and Flexibility in Justice -- On Judicial Work Under the Horizon of Flexible Justice

The Supreme Judicial Court of China puts forward the idea of ＂flexible justice＂ for the influence that the world financial crisis has placed on the economic society of our nation since 2008. They also inspire a trend to refresh judicial work around the theme of ＂serving for long term development and working for people＂ in the court circle. What＇s more, it has become a popular topic among them to talk about how to maximize their working efficiency through judicial operation. In this paper, firstly, the writer describes the theory basics and necessity of flexible justice in court, then combines the practice of judicial work and explore how to realize flexible justice from both the micro side and macro side. At the same time, he proposes the four relationships we should seriously deal with in the process of flexible justice.
