如何抑制网络服务商对信息网络传播权的侵权行为——由百度系列案为例

信息网络传播权是我国著作权法赋予著作权人、表演者和录音录像制品制作者的一项"专有权利"。在中国,网络服务商在信息网络传播中扮演着主导角色,涉及到侵权的可能性越来越大,提供的服务所引发的侵权诉讼也越来越多。本文以百度系列案为例,就何种行为构成著作法上网络服务商信息网络传播侵权,如何认定行为人的主观过错进行了探讨,并从立法完善的角度提出了一些自己的见解。

How to Inhibit Network Service Providers Infringing the Right of Information Communication Via Network--A Case Study of Baidu

The right of Information Communication Via Network written in our national Copyright Law is an ＂exclusive right＂ for copyright owners, performers and audio ＆ video recordings producers. In China, network service providers play a dominant role in information communication. The possibility of their infringement is becoming bigger and the number of infringement suits caused in the service is also increasing. Based on the study of Baidu＇s series cases, this paper discusses which kind of behaviors belongs to the tort to the right of Information Communication Via Network and how to identify a person＇s subjective faults. In addition, it puts forward some ideas in the aspect of technical support and legislation improvement.
