宣告死亡三题

宣告死亡制度的功能,在于保护失踪人利害关系人的人身利益和财产利益,我国民法其应坚持宣告失踪和宣告死亡两项制度并存的立法体例。被宣告死亡者在法律上被"推定死亡"。因意外事故下落不明,经有关机关证明该自然人不可能生存,利害关系人中请宣告其死亡的,不受民法有关宣告死亡之特别期间的限制。失踪人之利害关系人的宣告死亡申请权不应有顺序之分,特殊情形下应赋予检察院以死亡宣告申请权。
