论民众参与环境行政程序的依据

民众参与环境行政在环境问题凸显的今天越来越重要,其依据即合理性的讨论是学界首先应予关注的问题。一方面,环境权理论虽然无法直接作为民众参与环境行政程序的法律依据,但是通过对该理论的讨论和传播,却可以使人们普遍认同民众确定的享有环境利益,因此它可以作为民众参与环境行政最根本的理论支持,而这也是环境行政程序民主化和法治化的要求;另一方面,环境问题本身的特质也决定民众参与相关程序是法律的现实需求,而我国宪法、法律、法规和规章中都不同程度地存在民众参与有关环境行政程序的明确规定,这可以作为民众参与环境行政程序的实在法依据。

On the Foundation of Public Participation in Environmental Administrative Procedure

With the environmental problems being prominent,public participation in the environmental administrative procedure is becoming more and more important.We should pay our attention to the argumentation on it's foundation(rationality).On the one hand,though the theory of environmental right doesn't act as the direct law foundation of public participation in the enviromental administrative procedure,through the discussion and prevalence it can make the public identify themselves with people's definite environmental interests.so it can serve as the elementary law support for people's participating in the environmental administrative procedure,and it's the request for the democratization and law nomocracy of the administrative procedure.On the other hand,the environmental problem's specialty decides that public participation is the realistic need of law.Among the constitution,laws,regulations and rules all have some definite provisions about public participation in the environmental administrative procedure and they are the law basement for public participation.
