| 摘 要： | 医疗纠纷中举证责任倒置加大了受害人权利保护的力度,同时也加重了医方的责任。在对举证责任倒置进行法理依据、价值取向进行理性分析的基础上,提出应准确理解把握倒置的前提和内容,在举证责任向受害方倾斜的同时,也要兼顾医方举证能力的客观限制。

| Abstract: | The converting of onus probandi in medical dispute lawsuit enhances the dynamics of victim rights protection and aggravates the responsibilities of hospitals and doctors. So we should make a full understanding of premises and content of the converting, not only make onus probandi favorable to victims, but consider the objective limit of hospitals' onus ability. |
