| 摘 要： | 《反分裂国家法》在我国法律体系中起着承上启下的重要作用,对上秉承《宪法》维护国家领土完整和主权统一的基本精神,对下衔接《刑法》中制裁危害国家安全罪的具体措施。这部反映和平与统一精神的宪法性文件,把国家和平统一的意愿提升为国家的意志,并努力纳入法治运行的轨道,给政治上遏制台独、其他分裂势力及其活动提供了敦厚的法律依据。在国际上《反分裂国家法》具有正当性,使我国不论采取何种方式解决台湾问题、实现祖国统一不仅符合国际法的规则,而且也有国际实践先例的支持。
