论产业政策与竞争法的冲突与协调

产业政策与竞争法在具体成因与价值取向等方面的差异导致冲突的产生。但二者并非决然对立，不可调和。在经济全球化环境下，对于处于经济转轨时期的我国来说，协调二者的关系是十分重要。协调二者之间的关系应当明确协调原则、协调主体、协调方式，坚持以竞争法为主体，产业政策围绕竞争法进行协调的路径，并须谨慎评价我国《反垄断法》在二者协调方面的功能。
