| 摘 要： | 当国家参与国际交往时，应将国家行为分为公法的行为和私法的行为两种。在公法上的国家行为因为涉及到国家主权的原因，应该坚持国家豁免原则。在私法上的国家行为因为不涉及到国家主权的原因，应依据私法平等原则，废除国家豁免。
