论数人环境侵权之责任承担方式

数人环境侵权是一种新兴的环境侵权形态，表现形态主要有共同侵权行为，无意思联络的数人侵权行为，共同危险行为，教唆、帮助侵权行为等。针对数人环境侵权不同形态下侵权行为人的不同责任承担方式，研究连带责任制度与按份责任制度的适用，探讨连带责任制度的弊端以及扩大按份责任适用的现实性，提出构建以连带责任为主导，按份责任为补充的多元化责任承担体系，以期为数人环境侵权行为之责任承担机制的完善尽一点微薄之力。

A Study on the Liability Form of Several People Environmental Tort

Several people environmental tort is a new kind of environmental tort form. The main forms are joint tort with contact meaning, joint tort without contact meaning, the common dangerous behavior, abetting and helping joint tort. Tortfeasors under different forms of environmental infringement have different methods of responsibilities. This paper explores the applications of joint and several liability system and cutting apart liability system, the disadvantages of joint and several liability system, the reality of enlarging the scope of cutting apart liability. For the refinement of the environmental tort liability mechanism, the paper also puts forward to build a diversified liability system which takes joint liability as the leading form and cutting apart liability as the supplementary form.
