财产权视角下环境保护的经济学分析

摘    要:过度的财产权自由导致权利的滥用,进而发生环境污染与破坏。财产权与环境保护长期以来被认为是相互矛盾的法律概念。特别是在公有制占主导地位的中国,国家在环境保护政策的落实过程中对财产自由的规制加强了这一对概念的冲突。然而财产权并非环境问题产生的原因,财产权与环境保护也有相互促进的一面。如何利用财产权解决环境问题?如何避免环境保护“公地悲剧”的发生?不同的财产权体制各有利弊,如何选择最优的解决路径?本文通过理论分析提出利用财产权解决环境问题的各种路径,然后对各种路径进行利弊分析明确财产权在解决环境问题上的确切作用。

Abstract:The abuse of excessive freedom of property right causes environmental pollution and damage. Property rights and environmental protection has been regarded as a legal concept of contradictory for a long time. Especially in the leading position of the public ownership in China, in the implementation of the process of environmental protection policies of regulation on the property of the free strengthened this conflict of the concept. However, the property is not the cause of environmental problems, property rights and environmental protection promote each in other sides. How to use the property to solve environmental problems? How to avoid the occurrence of environmental protection tragedy? Different property right system have its advantages and disadvantages. How to choose the path to solve the optimal? This paper puts forward various paths using property rights to solve environmental problems through the analysis of theory, and then analyzes the advantages and disadvantages of various path clear property right, the exact role in solving environmental problems.
