对环境侵权问题进行法律调控的前提是对该概念给予正确的厘定。本文在探讨环境、环境污染生态破坏、侵权行为等概念的基础上,认为环境侵权是指以人为活动为原因,致使自然环境遭受污染或破坏进而危及不特定多数人的人身、财产或环境权益的特殊侵权行为。

A conceptual study of environmental torts

In order to regulate and control environmental torts by law,the prerequisite is to make a right conceptive classification of envirommental torts.In the essay,through illustrating a series of conceptious such as environment,environmental pollution,ecocide and torts, the author believes that environmental torts are special torts which refer to those that owing to human's behaviors, make natural environment polluted or destroged,then endanger most people's life,property and their enviroumental rights.
