古代戏曲创作主体思维特征论

文学创作是主体的审美体验过程。中国古代剧论家以主体心灵和主体情感审视戏曲艺术真实,强调审美主体内心真情实感的自然流露,相对忽略对历史和现实生活等审美客体的再现,偏重于创作主体内在心志和情感的表现。同时,他们依据戏曲艺术代言体的文体特性,主张剧作家细致体味戏曲人物生活的环境和遭遇的事件,做到因事造形,随物赋象。     

《梵天火罗九曜》考释及其撰写年代和作者问题探讨

首先分析了密教经典<梵天火罗九曜>的性质、内容、构成等,证实其为一部包含不少印度天文学内容的典型密教占星术经典.然后根据经文中提供的相关证据,用天文方法推算了该经的写作年代不晚于公元751年.并推断该经正文的主要内容极有可能出自一行的手笔或传授,但部分内容出于后人补述.另外,还对该经作为天文学在不同文化之间传播和融合之证据的重要意义做了深入阐发.     

电影作品的属性研究——以我国《著作权法》第15条修改为背景

研究电影作品属性是对电影作品著作权相关问题进行探讨的基础,是妥善解决电影作品的权利归属和利益分配问题的关键,具有重要的理论和实践意义。我国《著作权法》第15条的相关规定集中体现了我国对电影作品属性的定位,但存在许多不足之处:一方面对原作品作者的权利保护不足;另一方面对电影作品作者构成的规定过于僵化。目前,各国对电影作品属性的立法主要存在三种模式。三种模式各有千秋,是我国选择自己的立法模式、同时完善《著作权法》第15条之不足的重要参考依据。我国应抓住《著作权法》再次修订讨论的契机,结合本国实践并借鉴国外的立法经验对电影作品的属性进行系统地规定,并对相关条款做出修改。     

学术期刊出版中的多重版权法律关系研究

期刊论文作者的版权应以作者与期刊社之间的合同关系为优先考量,作者的版权不仅受到《著作权法》的保护,而且受到版权合同的约束。期刊作为汇编作品,其版权应受到尊重和保护。学术期刊的责任编辑为所责编的文章付出了智力性劳动,应享有相应的署名权。

编辑与版权法若干问题研究

期刊编辑出版的各个环节都与版权法密切相关。期刊刊发的必须是投稿人有发表权的文章。期刊的署名规范应尊重作者的署名权。编辑加工修改稿件不得侵犯作者的修改权和保护作品完整权。期刊编辑必须尊重作者的获得报酬权,并且要足额发放稿酬,低于法定标准的稿酬,以及拟收取版面费,应提前与作者协商一致。按照版权合理使用制度要求审视现有的规范抑或制定、执行新的合理的引文标示规范是尊重所有作者版权、防止刊发文章侵犯先前文章作者版权的有力举措。     

《徐伯轩先生行状》原作者考辨——兼论蔡元培与徐宝璜的交往渊源及其对中国新闻学的影响

本文认为新闻学术界借以了解中国新闻学大师徐宝璜生平的《徐伯轩先生行状》一文并非署名作者陈大齐原创,而是陈大齐在蔡元培所撰《徐宝璜先生行状》的基础上改写的.从两篇《行状》原作者的考析中,我们可以追溯蔡、徐两先生鲜为人知的私人交往渊源及其对中国新闻学所产生的深刻影响.     

《天净沙·秋思》的逻辑悖性及其消解

署名马致远的元曲《天净沙·秋思》内含情境和情理双重逻辑悖性。这种逻辑悖性是此曲在流传中被妄加修改而造成的。消解其悖性,不仅需要重新遣词,理顺情境和情理关系,也要纠正作者的署名。这样做不仅对弘扬优秀传统文化有正本清源的示范意义,对于当代施行的知识产权法规也有尊重和维护的意义。     

谈科技论文署名的新趋势

当前,论文的署名成为科技工作者十分关心的问题。本文就科技论文署名的发展历史、国际及国内的多作者化新趋势进行了综述。对2001--2008年期间我国科技工作者在Nature、Science等5个国际知名杂志所刊登论文的署名情况进行了统计分析,发现我国科技论文在署名和基金标注上融入了论文署名多作者化的国际新趋势。提出了我国科技工作者的论文署名在遵守国际规则方面的一些建议。
