公众参与立法的广度和深度是评价一国立法民主化水平的重要指标。从《物权法》制定过程中的公众参与来看,中国当前立法的公众参与,在显现出参与广度扩大化、参与深度增强化和参与主体群体化趋势的同时,也存在制度化建设不够、组织化程度不高和参与能力不均衡等问题。这些问题的解决有赖于相关制度建设的加强、利益表达渠道的拓展和公众参与能力的提高。 相似文献

在国家治理现代化的进程中,地方立法公众参与具有重要作用,可以促进地方立法的民主化、透明化和公正化。加强地方立法的公众参与,是实现地方立法现代化、推动社会发展的关键步骤,也是国家治理现代化中民主化、创新化、信息化、制度化的重要要求。现行地方立法公众参与机制的问题在于系统化的信息公开体制不完善,公众参与立法的动力机制不强,公众参与的方式和途径不健全,公众参与的意见反馈渠道不畅。据此,地方立法公众参与应当提升社会化参与水平,促进多元框架下主体协商,优化信息公开的程序,构建长效的参与机制。 相似文献

识别公众参与在环境影响评价中存在的问题并提出建议意义重大。本文在系统回顾中国环评制度发展历程的基础上,对厦门PX项目和四川什邡事件进行再审视,分析发现目前我国环境影响评价中的公众参与存在时点滞后、效果不佳、信息公开制度不健全、参与权和知情权难以得到保障和满足、滞后于城市建设与经济发展速度等5方面问题。鉴于此,文章从4方面提出建议:一是强化公众参与环境影响评价的外部保障制度建设;二是完善公众参与环境影响评价的实施细则;三是建立环境影响评价公众参与决策的倒逼机制;四是加强环境宣传和教育,提升公民环境意识和参与能力。 相似文献

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。 相似文献
