《劳动合同法》实现问题研究——兼以绥化市为例的调查分析

<中华人民共和国劳动合同法>(以下简称<劳动合同法>)因其调整的劳动关系兼具人身性和财产性,故其实现问题更凸显出重要性.<劳动合同法>的实现是劳动合同法的目的、功能、要求及其价值在社会生活中的实现.可从<劳动合同法>的实施及<劳动合同法>的实效两个角度去理解、比较.<劳动合同法>的实现面临诸多问题,因而研究<劳动合同法>的实现的对策具有重大的理论价值和现实意义.     

浅析代位权制度

本文从我国<合同法>第三条以及<合同法司法解释(一)>(11条-22条)(以下简称<解释>)关于债权人代位权制度的概念、特点、构成要件、债权人行使代位权的效力以及债权人代位权诉讼几个方面,分析了我国债权人代位权的制度,在<解释>11条的基础上提出了五要件说,并从我国制定债权人代位权的守法目的角度--卜肯定了我国债权人代位权制度的合理性.     

再析情势变更原则

情势变更原则是关于处理合同履行过程中由于情势变更引起合同效力变化的重要原则,我国《合同法》对此却无明文规定,从情势变更原则的有关基础理论问题出发,对确定情势变更原则不仅具有深远的立法理论基础,而且是实践的必需进行阐述,并籍此提出一项希望,即:确立该原则为我国即将颁布的《民法典》债权编的基本原则之一。     

论表见代理制度的法律价值和理论基础

1999年新<合同法>第一次以法律的形式在我国完整地确立了表见代理制度.尽管如此,我国学术界对表见代理的法律价值、理论基础等方面仍有较大的分歧.本文结合两大法系表见代理制度与我国表见代理制度的相关规定和现有理论研究成果进行了探讨,提出了一些个人见解.     

承诺对要约的实质性变更探微

我国<合同法>第30条、第31条与<联合国国际货物销售合同公约>等其它立法中的有关规定存在细微差异.学界在承诺对要约的实质性变更问题上存在五个认识方面的误区.我们应抛弃概念演绎型的思维进路,代之以标准界分型的思维进路,确立划分实质性变更与非实质性变更的合理标准.比较四种学说,"合理人标准"说及"出乎要约人意料"说较为可取.     

试论经济条件对小学英语教学的影响

我国从2001年起,开始实行国家英语课程标准(以下简称<标准>).为了了解<标准>的实施情况,本文通过问卷调查、访谈、课堂观察等方法对阳春市的小学英语教学现状作调查分析.调查结果表明:经济条件影响了小学英语教学的师资状况、教学条件、学习条件等,从而影响了<标准>实施,小学生的英语语言水平也难以达到<标准>的要求.对此,课题小组提出了相应的建议.

随着<物权法>的颁布实施,立法对物权变动主要模式的确立,以及我国立法对债权行为与物权行为划分的承认与严格区分,<合同法>第51条所确立的无权处分规定与其他法律规定存在的冲突已客观存在,并且此规则定与客观实践相抵触.无权处分规定涵需改革:有无处分权应成为物权行为及物权变动效力的判断因素,而非影响债权合同效力的要件.

对试用期内劳动者权益保护的新思考——兼评《劳动合同法》关于试用期的规定

试用期是劳动合同的一个重要组成部分.试用期是指用人单位与劳动者为了相互了解与相互考察,在平等和协商一致的基础上进行考察的一段时间.本文描述了现实生活中用人单位在试用期内侵权的各种行为及其表现,分析用人单位滥用劳动合同试用期的原因.在现行<劳动法>条文规定不足的情况下,<劳动合同法>对试用期做出了改革式的规定,对劳动者的权益保护升级.尽管<劳动合同法>对试用期进一步完善,但是还有许多缺陷亟待解决.本文根据本国实际情况,借鉴国外的经验教训,提出建设性的建议,尝试通过完善现行法律制度,对试用期限做出系统明确的规定,进一步保护劳动者在试用期内的权益.

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
